View Full Version : Got court on Feb. 1st... confused.

Okay... as most of you have read my thread a while back about how my mom sent me to jail because i was 'intimidating' her.
Well I finally have court now on Feb. 1st.
The cop explained to me before we left my house to go to the jail that the county/state/whoever had nothing to do with this... it was all at my mother's command. and apparently she was told that she cannot drop charges. why is this??
She didn't even intend on me going to jail. She just wanted me to go to a friend's place and stay there for a couple nights or something, but the officers took that wrong and cuffed me and hauled me off.
Its actually Assault to the 3rd degree, not domestic violence/intimidation apparently.

That has a description of 3rd degree assault.
The thing is that I never threatened to do anything to her. She screamed at me, "****ING HIT ME!" I replied, "I would never hit you." I didn't even yell it. **** this **** is a joke. Even if it only costs me like 100 dollars, still, that's 100 dollars I need in my pocket.

for any assault, somebody is goin to jail. these can not be droped sence you already spent some time in the big house. i could honestly see you doin a few more days. just tell your ma she owes you one.

i was already told that there would be no more jail time and at the most there would be just fines.
and since i have no prior offenses then i may very well get off..
my point i'm going to stress is that what i did doesn't follow under 3rd degree assault. i don't even think that it follows under anything.

cops are trained to lie. Ask one. The art of manipulation is key to their success. I hear Mexico is nice this time of year.

if your not going to juvie you need to get a lawyer and get this moved there... at that point it doesn't even matter. in nebraska you are a minor until you are 19... take advantage of this... make sure you have this applied to your juvie (sp) record and forget about it. After you turn 19 your juv. record disappears. so it will basically be like it never happened after you turn 19. you can also take diversion if they let you... do some community service and it's gone... kinda a shity deal you'd have to use your diversion card on a family issue.
btw. never ever trust a cop...

that has nothing to do with this board not liking cops because of street racing.. it's becomes cops in general will lie to you, and act like your bud to get information to convict you... their job is to find you guilty.. not find the truth.

yeah i kinda know how cops lie. but i have nothing but the truth to tell. because i honestly didn't do anything that physically harmed her. i never would. nor did i really do anything that threatened her in a menacing manner. i yelled as loud as i could at her. she gets on this power trip because she's old. she thinks she knows everything and if you're younger you cannot be right. yeah experience probably knows best. but i know when i'm right and when i'm wrong. i wouldn't keep going if i was that much in the wrong.
I've done some research... cases that fall under statute 28-310. everything i did was not defined under that statute.
i still have to call my lawyer... unfortunately it was one that is appointed by the state, so this person probably wont be any good really. but i think if i combine what i have learned from my readings and on this board with what he has, we can come up with something worthwhile.

If you heed no other advice than this...read carefully.
The harmless truth will be manipulated and twisted in any way possible to convict you. Do not offer ANY information without discussing it with a lawer first. They see things differently than you will.

i don't have anything to hide so i'm not too worried. i'm sure i've been through worse.
