Tonight I was leaving a house with a friend and took a **** on a tree and a car was coming so I thought no big d. But it turns out it was an undercover cop and he stopped me and my friend. My friend had a beer and he got an MIP. I was scared I was going to get one too. He asked if I had anything to drink and I eventually said yes I had 1 beer but I'm not sure how it will show up. Luckily I blew .000. So he just gave me urinating in public. When I think about it, he never actually asked me about the urinating, they were constantly asking if I had alch/drugs though.

I'm glad I didn't get MIP'd but can I try to get this dropped? Where or what would I do if I wanted to get it dropped? If I show up to court do you think I could get it dropped etc...

My record is clean btw.

I was drinking **** tons of water the whole day/night because I ran in a road race this morning. Was trying to stay hydrated. Was planning on having a couple beers and going home early.

(Inb4 someone says don't drink beer if your trying to stay hydrated)

You can always talk with the city/county attorney to see if they are willing to work out some kind of plea bargain. That would be a pretty embarassing thing to have on a record when an employer does a background check.

Omaha doesnt have a "Urinating In Public" city law, but per our prosecutors, it is littering. I have only arrested one person for that, but it was a homeless guy pissing on a powerbox outside of walmart. I figured it was that, or a death investigation later.

I don't think that conviction sounds any better. If anything, everyone knows why he got busted if he got a ticket for urinating in public. If someone had a public indecency charge, that leave a lot to the imagination.

yap. repost but on my 21st I got public indecency, littering (apparently **** is littering), disturbing the peace, and public intox.... Ended up getting disturbing the peace and public intox basically forgotten but the other 2 with court costs and such was damn near 1400$....

Technically no. But unless you write your name in the snow or do it right in front of a cop, you should be fine.

Most people think of urinating in public, having sex in a car in view of the public, etc as Lewd Conduct. However the way that the statute is written, you have to have "intent to cause alarm" in order to get convicted of lewd conduct. So if you are just trying to keep from pissing your pants or nut on a chicks face there is no intent to cause alarm.

OP: If you have no record, I would talk to the prosecutors prior to your court date and ask about probation or diversion.

I heard of a guy in Omaha getting in trouble for being naked in his own home, because he had the blinds open all the time.

Not trying to do diversion for urinating in public haha, not worth it really.


Random question people always seem to have different opinions on and I never know who's right......
Does anyone know if a person gets an MIP at age 19 or 20 if they can do diversion to get it off their record?

Ya it was like $125 after everything for mine. I just paid the fine. Didnt bother fighting it. I was ****ing hammered and considered myself lucky for not going to detox or getting public intoxication or anything. Preston talked the cop into not taking me to detox, luckily.

Some people don't want stupid **** like that coming up when a potential employer does a back ground check, I believe that was his point in posting that idea.
