Filing assault charges

Im going to try and make this as short as possible. Last night a friend and I were finishing up lifting at the gym and went to sit in the sauna. There were a total of 4 people in it including us. There was an asian guy to my right and some lady to my left. I was just talking to my friend about work we said nothing racial or anything to offend this guy. I had my ipod in my right ear. This asian guy stands up and i faintly hear "shut the **** up" not knowing who hes talking to I look up and he cold clocks me in the face.

He hit my nose just right it was a river of blood so I didnt retaliate and just went to the bathroom to get the bleeding to stop. After he hit me hes like "do you know who i am?". Now i had never seen this guy in my life and had not ****ing clue who he was.

I went to the desk to report the incident and of course he was gone by the time i got out of the bathroom. The lady that was in the sauna said the guy quietly told her to be quiet right before this happened and of course i didnt hear it b.c i had my ipod in that ear. I filed a police report and they have a video of him and the lady behind the desk said he was in there every night.

They got the name of the lady he walked out with but conveniently not his name. I ended up going to the ER b/c my eye was blurry and i couldnt see. I have a hyphema or internal bleeding on the colored part of my eye that can cause vision loss if i dont stay elevated and use these eye drops i got to help it heal. Now this kinda **** has never happened to me before and i dont know how to go about following up on it as im not letting this just go. At minimum i dont want to be responsible for my medical bills. Any advice on how i should proceed would be greatly appreciated.

trust me if i was being a ***** and talking **** and got my ass beat I wouldnt post it on here asking for advice. I'd take what i had coming to me. We were literally in there for 10 mins talking nothing but about work related and nothing racial what so ever. I've never seen the guy in my life and have no idea who he was there is nothing more to the story.

he was definitely a guy who looked like he took steroids or could be on them. He was def. fit for his size being a smaller guy, im 6'4 185. I went to the optimologist today to look at my eye and they took pics of the blood area, its all dialated now and not much to see, its only slightly swollen now also.

You said you filed a police report correct? If so there is record of the incident and also you have medical bills you are more than entitled to sue him. You don't need a lawyer for a small claims case. Which unless you are wanting thousands of dollars you will be filing in small claims. Your case seems pretty cut and dry if you have a police report, witnesses and medical bills.

2nd i cant sue b/c no lawyer is going to take my case unless he has money which is doubtful. On personal injury cases if a lawyer takes the case they front the funds and take a 1/3 of the proceeds if the case is won in my favor so unless a decent amount is involved id have to pay for a lawyer. The could look at garnishing the guys wages from his job but who knows what his employment is like. I cant take him to small claims b/c they do not do personal injury cases. Im pretty much SOL and can only press charges on him and hope he gets arrested at most.

I was in one of these predicaments in June. Started 1v1... ended up 1v8 and broken nose/eyesocket. I do not have insurance and the bill was a serious chunk of money - reason for pressing charges and suing for medical bills. They please not guilty first court appearance so I got subpoenaed to testify Tuesday (dumb cause they already know I do not remember a thing).
