well long story short, i got a ticket for shoplifting. but didnt steal anything. i was at scheels gettting batting gloves for my bro for xmas and was trying on 2 different pairs and accidentally put the more expensive ones in the cheaper box. i wanted the cheaper ones but the boxes looked the same besides the price tag and the gloves were the same besides a small piece of padding and got them mixed up. i didnt tear anything, remove any price tags or anything. i went and paid and a guy grabbed me pulled me in a room and told me they had me on tape for shoplifting. i explained to them it was a mistake and i didnt steal them i just accidently switched them around. they called the cops and he gave me a ticket for shoplifting. my court date is later in the month and i got a letter from diversion saying i can take the class and do the community service and it will get removed from my record since my record is clear. so do i have any chance at fighting this or should i just plead guilty and do diversion. any help would be nice. thanks

I'm not gonna lie, but your story sounds like bullshit. How big of a price difference between the 2 gloves? Obviously not much if the gloves are essentially the same thing. If it wasn't a big difference, the cops can tell security that they're not gonna waste their time with a ticket. I had that happen a few times when I did security and we caught people. Usually most retail store policies are over $20 loss and sometimes up to $50 loss and up they only prosecute. Stuff under that they only have you sign a civil restitution agreement.
But you're doing a good job of denying things. Thats always a plus with protecting yourself with our CJ system.

lol i know the story sounds like bullshit thats why they wouldnt listen to me. ive never stolen a damn thing before. i had alot on my mind that day with xmas and what not and i took them both out of the package to try them on. and put them back in and grabbed the one with the cheaper price(the ones i wanted) all im asking is since i actually didnt do it and i didnt remove price tags or anything do i have a chance if i plead not guilty. cause i dont wanna do diversion for something i didnt do.

If the video show's that it was an accident and you weren't looking around and being hesitant and the video shows it was a legit mistake that may help your case.

yea they showed me the video i set my other items down looked for the right size and color tried them on put one back on the front of the rack and walked away

^^this. But go to court and explain to the judge what happened.If you have a clean record he might toss you a bone..
dont waste any money on a lawyer as he wont be able to do ****. You don't want a shoplifting cherge on your record(or anything for that matter). Don't plead guilty it will **** you later on in life when it comes to jobs and stuff.

Doubtful theyd persue a such a small $$$ shopplifting charge when they have nothing concrete to back it up with. Id plead not guilty and see what happens. Chances are theyve got better things to do than to take it to court.
