I have found that knife laws are very vague. I have had butterfly knifes confiscated by cops and been told there illegal. But i was looking up laws and all i found was a sub law in lincoln that switchblades are illegal. Now it does say that carrying a concealed knife with a blade a 3.5 inches is illegal but any knife under that is considered a pocket knife. And what do they measure as the blade. The sharp part or the whole metal piece. Can anyone shed some light on this for me.
Nebraska - Crimes and Punishments. 28-1201. Terms, defined...
(4) Knife shall mean any dagger, dirk, knife, or stiletto
with a blade over 3-1/2 inches in length or any other
dangerous instrument capable of inflicting cutting,
stabbing, or tearing wounds...
- 28-1202. (1) ...any person who carries a weapon or weapons
concealed on or about his person such as a... bowie knife,
dirk or knife with a dirk blade attachment... or any other
deadly weapon commits the offense of carrying a concealed
weapon.
(2) It shall be an affirmative defense that the defendant
was engaged in any lawful business, calling, or employment
at the time he or she was carrying any weapon or weapons
and the circumstances in which such person was placed at
the time were such as to justify a prudent person in
carrying the weapon or weapons for the defense of his or
her person, property, or family.
Nebraska Case Law:
- "Whether an object or weapon not specifically enumerated in
subsection (1) of this section was a deadly weapon is a
question of fact to be decided by the trier of fact."
(1983)
- "Section 28-1202(1)... is sufficiently definite to meet the
requirements of the first and fifth amendments to the U.S.
Constitution and Art. I, section 3, of the Nebraska
Constitution..."

The metal part of the knife which is considered the blade would be measured. Wouldn't matter if it was halfway sharpened that would be the edge.

So it's illegal to walk around with a knife in your pocket with a blade longer than 3.5''?
Huh, I had no idea, I've broken that law a billion times.

No, I was already a hardened criminal when I attempted to defraud the state out of sales tax on my camaro.

I dunno. I just wrote down $2500 instead of $7500 (guy gave me a blank BOS and a partially filled out title). I just wasn't expecting the DMV to actually call the seller right there on the spot and verify the sale price with him. The guy would have gladly told them $2500 for me, but I never even discussed it with him. I've never heard of them actually calling the seller before like that. I'm just the unlucky one in a million that got caught doing what everybody does at the DMV. They even had a cop walk over with handcuffs out and the whole bit.
It was pretty funny because the conversation went like this.
*lady and cop walk over with the title after getting off the phone*
Lady: "We just got off the phone with Tyler. So exactly how much did you pay for this car?"
Me: "Why do you ask? Did he say something different than is written down there?"
Lady: "Alright we gave you a chance to tell the truth, but you just lied and we have a witness. *signals cop* Arrest him. Tax fraud is a felony you know."
Me: "Woah woah woah, I never lied, I just asked a question. I paid $7500 for the car, that's what it should say on the papers. Did I fill something out wrong?"
So now I'm correcting a mistake on my paperwork instead of going to jail because the lady gave up her master plan before actually catching me doing anything wrong.

It's legal to carry a pocket knife over 3.5" as long as it has a clip because then technically its not concealed

It makes me feel like a bad ass. I also carry a pistol and I got a pocket full of rubbers and my home boys do to.

I get the fishing part, and hunting part, that makes sense.
and the tiny pee pee too I guess.
I think If I ever felt the need to carry a weapon I would just buy a gun and get a ccw.

A knife can be drawn faster than a gun in most situations. Read: I said most, not against a quick draw champion.

It's a shame more quick-draw champions don't become criminals.

Plus a knife is easier to cut stuff with and quieter.
matt

well yea, I would just imagine if I had a threat approaching me, I would want a gun. not a knife, I guess if you were already in a fight you could cut somebody up, but as far as self protection, from like a robber. I personally would prefer a gun. idk

I'd like to say I'm proficient with a gun and shoot them on a regular basis, I carry a knife with me everywhere I go though. Not that I've ever had to use it in a bad situation or plan to, they come in handy.

Like a pliers or a vice grip. It isn't always about protection Matt, jeez where do you live? Personally I prefer a Tee Ball bat to a knife.
Mostly cause blunt force trauma is so much cooler sounding that laceration.
