well last night i pull up to my house at 4 in the morning and a cop pulls up right behind me. I know the cop and he tells me to come over to his car. He asks me where i've been and what i've been doing because someone said i did a gas and go wtf haha. He just asked for my phone number so they could call me for more questions, he leaves my house then 10min later he comes back and gives me a ****ing ticket for driving under suspension!! how the **** can he do that? He didnt even pull me over he just stopped to ask me a question, then he leaves and comes back to give me a ticket?

theres no way that should hold up in court though. Thats like going to a party and seeing some minors drinking, then coming back 15min later and noboy is drinking and no beer around but then giving them MIP's, its bullshit.

does not matter the cop giving the ticket witnessed the crime being commited. thats all thats needed. he is a witness. you argument would kinda make witnesses useless in court cases. or how about survelance cameras some one breaks into an ATM camera catches them but sense no cop was there to arresthim/write a ticket then he gets away

i think its like 6 months on the statute of limitations for traffic violations. but suspended license could be different

01SOMZ28
22nd November 2008, 02:03 PM
Yea he saw me pull up to my house, talked to me about something totally different, doesnt ask for my license or anything just my number and address. Then 5-10min later comes back to give me a ****in ticket for driving under suspension? There is no way it will hold up in court

 thats not true because the deputy that came to my house along with the cop to ask me about last night, was the same deputy that i ran from on hwy 77 back in 07 on my way up to ameracruise. She knows it was me because there is no other camaro in town that looks like mine and i was even bullshitin with her last night about me runin from her on the highway but she said there is nothin she can do about it since it was so long ago.

do you have a suspended license? All he needs to see is you driving, and he did. so you get a ticket for it. in this case he didnt find out you had a suspended license untill after he left. had he ran your license rite there you would have gotten it.

when you do take it to court, be sure to tell me how well that goes for you

01SOMZ28
22nd November 2008, 02:13 PM
i will let you know because it shouldnt hold up in court, i'll plead not guilty and get a lawyer if i have to.

like i stated above 6 months on trafic violations. every severity of crime has a difference in the statute of limitations. traffic has 6(i know this becuase my old man is a cop) **** like theft armed robery will be more murder has no limit.

face it your ****ed and if you try to come into court saying "sense he didn't give me a ticket then, it don't count" they will laff at you

sweatygrundle
22nd November 2008, 02:19 PM
the only way you will be able to play it off is sense he didnt ask for your license to mach the pic to your face then you could try to claim it wasnt you they saw drive and then get out of the car then talk to them.

01SOMZ28
22nd November 2008, 02:23 PM
:ohnoes: oh no they're gonna laugh, i could give a **** less. I dont think i'm in the wrong, i think its bullshit so i'm gonna fight it. If i lose then o well, i tried, and it would still be bullshit.

sweatygrundle
22nd November 2008, 02:29 PM
it all comes down to someone witnessing a crime. the cop witnessed you drive and wrote you a ticket for it. timing does not matter. and cops are usually considered credible witnesses. count yourself lucky he didnt pull you over somewhere else they would have towed and impounded your car.

01SOMZ28

Oh, so you weren't driving under a suspended license? Then you have nothing to worry about. Just show up, and tell em, "Hey, settle the **** down! My license isn't suspended."

You'll be fine.

Now why would you go and do that?

Shouldn't have answered the door the second time. I was followed home late one night and after I parked and went inside a cop showed up knockin' on the door, I just shut off the lights and went to bed and I never heard on the matter again. They can't just come barging in the house with their only reason to give you a ticket.

matt
22nd November 2008, 05:33 PM
I would get a lawyer, and just say it was your buddy driving and you in the passenger seat, he has no evidence that you were driving

5thgenBB6

wouldnt it be a secondary offense, like the seat belt law?

i was thinking about going to court and just telling them that i had to move my truck from the back of my house to the front an park it on the street and thats all i was doing, and the cop just happened to pull up as i was getting out and has no proof that i was driving around town...i was just moving my truck out of the way behind my house....it could work :hmm:

KyleJ
23rd November 2008, 01:47 AM
It could work, until you posted it on a public forum admitting what you did to everyone that has access to the internet. Not saying that would or could happen, but these boards are frequented by pigs.

How bad is the violation, just a fine and have it suspended longer?

Ok, so your going to try to tell them the cop had no proof that you were driving when he saw you get out of the car on the street. If you're on the streets in a vehicle, you're considered to be driving. You got caught, just man up and take your punishment.

When I got pulled over with a suspended license, they just extended my suspension and I had to pay a nice fine.

well my license should have never been suspended in the first place, its my fault its suspended because i got a letter from the dmv saying that i need to take an 8hr driving course within 3months of recieving the letter....i forgot to do it...and thats why its suspended. I just got done with the 8hr class 2night and ill get it back next week. But i'm not sure whats going to happen if i cant get it dropped.

sweatygrundle
26th November 2008, 12:05 AM
if you go and get it back asap they might be a tad leniant on you. well thats how the judges worked where i grew up. but if the judges are as much a douche bags as the cops there in beatrice you still will probly be fuct

TinkeredTA
3rd December 2008, 05:48 PM
If you took the class I don't think it will make a difference. You still did it prior to getting your license back while under suspension. If you tell them you just moved it, your still going to get screwed for operating a motor vehicle. The cop will come testify in court he saw you get out of the drivers door after it was moved, they'll take his word over you anyday. But they may be more lenient because you were just "getting it out of the way" and you took the class. Its a 50/50 toss up on the judge.

Let us know how it goes/went if you already had court.

i'm just gonna go to court and plead not guilty and tell them to prove it, i want to see it on video.

żumop apisdn

Because video is necessary to find someone guilty.

If you can get your license back you're fine, its just a $100 fine. Go to court say you want to get it back, and they'll give you whatever time you need. Then you just go back to court like a month later or whatever, show them the reinstatement letter, and they slap you on the wrist with a small fine.

Oh ya, and "prove it" by video, is asking for hell. If you win, congrats, but otherwise its just throwing away a **** load of money. They dont have to have a video, they just have to be more convincing than you.

I got 3 suspended license tickets in 2005 and had I been able to get my license back the judge was going to drop all 3. But I wasn't able to get my license back and lost it for a total of 2 years.

Ya I had this happen a few months back. They didnt even have a record of my suspension, and I had to jump through hoops and like 3 court dates just to deal with mine.
